Ciarán Cuffe asked the Minister for Justice, Equality and Law Reform
his position in relation to the EU Data Retention Directive recently
passed by the EU Parliament, if he nitends to take a legal challenge
against the EU Commission and Parliament in relation to the Directive;
and if he will make a statement on the matter. |

Justice, Equality and Law Reform:
The draft directive to which the Deputy refers has yet to be adopted.
The question of any legal challenge that might be brought by Ireland in
respect of this instrument would be determined on the basis of advice
provided by the Attorney General and approval by the Government.
